Article 1 In order to effectively promote the creation, application, protection, management and services of intellectual property rights, and to promote the construction of Hainan Free Trade Pilot Zone and Free Trade Port with Chinese Characteristics through the development of intellectual property rights, these regulations are formulated in accordance with the spirit of the "Guiding Opinions of the CPC Central Committee and the State Council on Supporting Hainan to Comprehensively Deepen Reform and Opening Up" and the "Several Opinions of the State Council on Strengthening the Construction of an Intellectual Property Power under the New Situation", and in combination with the actual situation of our province.
Article 2 These regulations apply to enterprises, institutions, colleges and universities, scientific research institutions, intermediary service agencies, and other social organizations and individuals within the jurisdiction of Hainan Province, except for special provisions in individual clauses. The funding and reward projects listed in these regulations are all post-subsidy, and all projects refer to projects completed in the previous year.
Article 3 Inventions and creations are encouraged, and each invention patent that obtains domestic authorization with an address in this province will be subsidized by RMB 8,000.
Article 4: For foreign patent applications filed through the Patent Cooperation Treaty (PCT) and the Paris Convention, after the international phase examination is completed and the patent is published in the country (region), a subsidy of 10,000 yuan will be given for each application; for patents authorized abroad, a subsidy of 60,000 yuan will be given for each application in Europe, the United States, and Japan, and a subsidy of 30,000 yuan will be given for each application in other countries (regions).
Article 5: For international trademark applications filed through the Madrid system, after the international phase examination is completed and the patent is published in the World Intellectual Property Organization (WIPO) International Trademark Bulletin, a subsidy of 10,000 yuan will be given for each application.
Article 6: Encourage the protection and use of geographical indications, and provide a subsidy of 100,000 yuan for each approved geographical indication protection product or geographical indication trademark.
Article 7: Support the cultivation of new plant varieties and encourage the promotion and application of new plant varieties. The provincial business department is responsible for reviewing the new plant variety rights granted by the national business department, and provides a subsidy of 100,000 yuan for each application.
Article 8: Encourage enterprises and relevant units in our province to transform technology into international standards, national standards and industry standards. For patent technologies that are converted into international standards, a reward of 100,000 yuan will be given for each; for patent technologies that are converted into national standards and industry standards, a reward of 50,000 yuan and 30,000 yuan will be given for each.
Article 9 Financial institutions and credit guarantee institutions are encouraged to provide pledge loans, guarantees and other services for the transformation and application of intellectual property rights. The standards and scope of application of specific subsidies and compensations shall be implemented in accordance with the "Hainan Province Intellectual Property Pledge Financing Management Measures".
Article 10 Encourage the exploration of intellectual property securitization. For intellectual property securities successfully issued in the pilot, a reward of no more than 500,000 yuan will be given for each order; a reward of no more than 100,000 yuan will be given to the leading organizing unit. This article applies to intellectual property rights holders and leading units who explore intellectual property securitization under the guidance of the Hainan Provincial Intellectual Property Management Department.
Article 11 Patent holders who have won the China Patent Gold Award, Silver Award, and Excellence Award will be awarded 600,000 yuan, 400,000 yuan, and 300,000 yuan respectively. Patent holders who have won the Hainan Province Patent Gold Award and Excellence Award will be awarded 150,000 yuan and 100,000 yuan respectively. Those who have won both the China Patent Award and the Hainan Province Patent Award for the same project in the same year will not be awarded repeatedly.
Article 12: Enterprises that win the China Trademark Gold Award will be awarded 500,000 yuan. Enterprises that win well-known trademarks will be awarded 300,000 yuan.
Article 13: Enterprises with intellectual property advantages recognized by the State Intellectual Property Office, and the units have more than 3 valid invention patents, will be awarded 300,000 yuan; intellectual property demonstration enterprises recognized by the State Intellectual Property Office, and the units have more than 5 valid invention patents, will be awarded 500,000 yuan.
Article 14: Enterprises, universities, and scientific research institutions that pass the national standard certification of "Enterprise Intellectual Property Management Standards" (GB/T29490-2013), "Institutions of Higher Education Intellectual Property Management Standards" (GB/T33251-2016), or "Scientific Research Organization Intellectual Property Management Standards" (GB/T33250-2016) for the first time will be subsidized for the actual certification costs incurred, and each subsidy shall not exceed 50,000 yuan.
Article 15 Encourage primary and secondary schools to popularize intellectual property education. Schools listed in the national intellectual property education pilot and demonstration programs will be given 150,000 yuan and 200,000 yuan in funding support respectively; schools listed in the provincial intellectual property education pilot and demonstration programs will be awarded 100,000 yuan and 150,000 yuan respectively. The funds are used to popularize and support intellectual property education and reward teachers and students for inventions and creations.
Article 16 The provincial intellectual property management department shall provide funding and rewards for intellectual property research and system innovation according to the needs of the province's intellectual property work. This article applies to domestic enterprises, institutions, colleges and universities, scientific research institutions, intermediary service agencies, and other social organizations and individuals.
Article 17 The Hainan Provincial Intellectual Property Office is responsible for interpreting these regulations.
Article 18 These regulations shall come into effect on May 1, 2020 and shall be valid for 5 years. If there is a conflict between the relevant normative documents before the implementation of these regulations and these regulations, these regulations shall prevail.
