Interim Measures for the Management of the List of High-end and Shortage Talents Enjoying Personal Income Tax Preferential Policies in Hainan Free Trade Port
Article 1 In accordance with the "Hainan Free Trade Port Law of the People's Republic of China", "Overall Plan for the Construction of Hainan Free Trade Port" and "Notice of the Ministry of Finance and the State Administration of Taxation on the Personal Income Tax Policy for High-end and Shortage Talents in Hainan Free Trade Port" (Finance and Taxation [2020] No. 32), these measures are formulated to implement the personal income tax preferential policies for high-end talents and scarce talents in Hainan Free Trade Port.
Article 2 A list management system shall be implemented for high-end talents and scarce talents who work in Hainan Free Trade Port and enjoy preferential policies.
Article 3 The following conditions shall be met to enjoy preferential policies:
(I) Live in Hainan Free Trade Port for a total of 183 days in a tax year.
(II) Talents recognized by talent management departments at all levels in Hainan Province or whose income in Hainan Free Trade Port reaches RMB 300,000 or more in a tax year (Hainan Province implements dynamic adjustments based on economic and social development).
Article 4 Specific personnel in the aviation, shipping, offshore oil and gas exploration and other industries who have lived in Hainan Free Trade Port for less than 183 days in a tax year due to their occupational characteristics, while meeting the second paragraph of Article 3 of these Measures, have continuously paid basic pension insurance for employees in Hainan Free Trade Port as an employee of a unit (except for those exempted from payment in countries that have signed social security agreements with China) for more than 6 months (including December of the current year) in a tax year, and have signed a labor contract or employment agreement for more than 1 year with an enterprise or unit registered and substantially operating in Hainan Free Trade Port, or can provide other labor and personnel relationship certification materials with equivalent conditions, shall submit an application to the tax department within the prescribed time and explain the situation. After being reviewed and approved by the Hainan Provincial Human Resources and Social Security Department, they can enjoy preferential policies.
Article 5 The Hainan Provincial Human Resources and Social Security Department is responsible for formulating the industry demand catalogue of scarce talents in Hainan Free Trade Port.
Article 6 The human resources and social security department of Hainan Province shall, together with relevant departments, submit the list of people who enjoy the preferential individual income tax policy to the tax department of Hainan Province on a regular basis in accordance with these Measures.
Article 7 People who are determined to be high-end talents and scarce talents shall enjoy the preferential individual income tax policy in that year. People who no longer meet the conditions of high-end talents and scarce talents shall not enjoy the preferential individual income tax policy in that year.
Article 8 People who are listed as the objects of joint punishment for dishonesty in accordance with the law shall not enjoy the preferential individual income tax policy.
Article 9  Relying on the social management information platform of Hainan Province, the human resources and social security, public security, market supervision, taxation and other departments of Hainan Province shall strengthen in-process and post-process supervision, conduct random inspections on the enjoyment of the preferential individual income tax policy, and carry out risk assessment and risk response work based on the inspection results.
Article 10  If there are objections or disputes about talents who enjoy the preferential individual income tax policy, the human resources and social security departments at all levels in Hainan Province shall take the lead in coordinating and resolving them. If there are objections or disputes about whether the enterprise or unit to which the talent belongs has carried out substantive operations in the Hainan Free Trade Port, the market supervision and management department of Hainan Province shall take the lead in coordinating and resolving them.
Article 11 The departments of human resources and social security, public security, finance, market supervision, taxation, etc. of Hainan Province may formulate specific implementation regulations in conjunction with these Measures.
Article 12  These Measures shall come into force on January 1, 2023. The Interim Measures for the Management of the List of High-end and Shortage Talents Enjoying Personal Income Tax Preferential Policies in Hainan Free Trade Port (Qiongfu [2020] No. 41) issued by the People's Government of Hainan Province on August 26, 2020 shall be repealed at the same time.
