Notice of the General Office of the Provincial Government on Issuing the Sanya Yazhou Bay Science and Technology City Intellectual Property Special Zone Construction Plan (2021-2025)

Recently, Hainan issued the "Sanya Yazhou Bay Science and Technology City Intellectual Property Special Zone Construction Plan (2021-2025)", which will benchmark the highest international standards and best levels, focus on the integrated innovation of intellectual property protection and application systems in the fields of "Southern Seed Industry" and "Deep Sea Technology", and create a national seed industry intellectual property protection demonstration zone and a national intellectual property comprehensive protection pilot demonstration zone.

Sanya Yazhou Bay Science and Technology City Intellectual Property Special Zone will refer to the main provisions of the 1991 text of the International Union for the Protection of New Varieties of Plants (UPOV) to pilot the substantive derivative variety system and effectively improve the level of protection of new plant varieties. Hainan will give full play to the "three-in-one" functions of the Hainan Free Trade Port Intellectual Property Court, optimize the jurisdiction mechanism of cases involving new plant variety rights in the free trade port, explore the effective connection of civil and administrative disputes involving new plant variety cases, and establish a trial mechanism that is compatible with the construction and development of the special zone and meets the characteristics and needs of the special zone.

★ Promote the "five-in-one" intellectual property comprehensive management system with administrative management and comprehensive law enforcement functions for patents, trademarks, copyrights, geographical indications, and new plant varieties.
★ Integrate administrative law enforcement, administrative adjudication, arbitration and mediation, judicial trial, social supervision and other resources to promote an "integrated" intellectual property protection mechanism.
★ Realize the centralized acceptance of intellectual property business through a "single window", promote the "one-stop" service of intellectual property business services, government services and information services, and establish a "one-stop" comprehensive service system.

At present, Sanya Yazhou Bay Science and Technology City has set up an intellectual property comprehensive management hub port, a public legal service center, an arbitration and mediation center, the Chinese Academy of Agricultural Sciences South Breeding Research Center and the Ministry of Agriculture and Rural Science and Technology Development Center Molecular Detection Laboratory, and is accelerating the construction of the China (Sanya) Intellectual Property Protection Center, the Hainan Free Trade Port New Plant Variety Protection Examination Cooperation Center, the National Plant Variety Testing (Sanya) Center, and the Intellectual Property Circuit Trial Point.
