Hainan Enterprise R&D Institution Recognition and Registration Management Measures

Chapter I General Provisions

Article 1 In order to implement the "Three-Year Action Plan for Hainan Province to Win the Scientific and Technological Innovation Turnaround with Extraordinary Means (2021-2023)", strengthen the main position of enterprise innovation, and support enterprises in technological innovation, transformation of scientific and technological achievements, and technical services, this construction guideline is formulated.

Article 2 The enterprise R&D institution referred to in this guideline refers to an institution established within the enterprise to engage in scientific research, new materials, new technologies, new products, new process research and development, as well as design, testing, inspection and other related technical services. It is the basic condition for enterprises to carry out technological innovation and achieve scientific and technological progress.

Article 3 Enterprise R&D institutions shall be identified and registered in accordance with the self-construction, voluntary declaration, and hierarchical methods of enterprises.

Article 4 The identification, registration, evaluation and management of enterprise R&D institutions shall follow the principle of "openness, fairness and justice".

Chapter II Division of responsibilities and main tasks

Article 5 Division of responsibilities

(I) Enterprise responsibilities. Enterprises are the main body of R&D institution construction and management. They support high-tech enterprises and industrial enterprises above a certain scale to build their own R&D institutions based on their actual conditions. For those that do not have the conditions for self-construction, they can jointly build R&D institutions.

Self-built R&D institutions refer to internal R&D institutions that are self-established by enterprises in the province or jointly established by enterprises and external units, and in principle are relatively independent of the production system in management (or separately accounted for).

Jointly built R&D institutions refer to R&D institutions that do not have the conditions for independent R&D institutions, and use the R&D sites, R&D personnel, and R&D equipment of scientific research units such as universities, scientific research institutes, industrial (industrial) research institutes, or large and medium-sized enterprises to conduct research and development of products, technologies, processes, materials, etc. for the enterprise through cooperation or entrustment.

(II) Responsibilities of municipal and county science and technology management departments Municipal and county science and technology management departments, together with relevant departments, are responsible for the cultivation, identification and filing of enterprise R&D institutions in their regions, as well as follow-up management and services.

(III) Responsibilities of provincial departments. The provincial science and technology management department, together with the Ministry of Industry and Information Technology and other provincial departments, shall coordinate and promote the development of enterprise R&D institutions across the province, study and formulate support policies, and be responsible for the identification and filing of provincial enterprise R&D institutions.

Provincial enterprise R&D institutions include but are not limited to provincial key laboratories, engineering technology research centers, technology innovation centers, manufacturing innovation centers, engineering laboratories, academician workstations, academician team innovation centers, and scientific and technological achievement transformation centers that have been identified by relevant industry authorities in our province.

Article 6 The main tasks of enterprise R&D institutions:

(I) Develop marketable new materials, new products (varieties), and new technologies for enterprises; apply high-tech to transform and upgrade the traditional process technologies of enterprises; digest, absorb, and re-innovate the scientific and technological achievements introduced by enterprises.

(II) Carry out talent exchanges and cooperation, and train high-quality engineering and technical personnel and engineering management personnel that are urgently needed for enterprises.

(III) Carry out industry-university-research cooperation, and provide R&D, design, experiment, testing, inspection and other services.

Chapter III Conditions and Filing and Recognition Procedures

Article 7 R&D institutions of enterprises shall generally meet the following basic conditions:

(i) The enterprise has been registered in Hainan Province for more than one year and has independent legal person status. The enterprise's main R&D and production activities are in Hainan Province;

(ii) The enterprise has intellectual property rights related to its main business (patents, software copyrights, integrated circuit layout design rights, national new drugs, new plant varieties, etc.);

(iii) The total R&D expenses of the enterprise in the previous year are generally not less than 200,000 yuan;

(iv) The number of R&D personnel is not less than 5, and there are fixed places, scientific research instruments and equipment for R&D and achievement transformation;

(v) There are not less than 2 research projects (including enterprise-initiated projects) in the fields of new materials, new products, new technologies, new processes, new materials, etc.;

(vi) A complete and standardized technology innovation management system is established, and various rules and regulations are clear.

Article 8 Recognition and filing of provincial enterprise R&D institutions. Enterprises applying for provincial key laboratories, engineering technology research centers, technology innovation centers, manufacturing innovation centers, engineering laboratories, academician workstations, academician team innovation centers, and scientific and technological achievement transformation centers shall be recognized and managed by relevant provincial units in accordance with the corresponding management methods.

After approval, the enterprise shall submit the relevant certification materials to the provincial science and technology management department for review (the innovation platform recognized by the provincial science and technology management department shall no longer submit relevant materials repeatedly), and those who meet the conditions shall be registered.

Article 9 Recognition and filing of municipal and county-level enterprise R&D institutions. Municipal and county-level enterprise R&D institutions shall be recognized and managed by municipal and county science and technology management departments in conjunction with relevant departments in accordance with relevant municipal and county management methods.

After approval, the municipal and county science and technology management departments shall submit the relevant materials to the provincial science and technology management department for review, and those who meet the conditions shall be registered.

Article 10 Registration of other enterprise R&D institutions. Other enterprise R&D institutions that do not meet the conditions of provincial, municipal and county-level enterprise R&D institutions shall be registered in a year-round acceptance and regular announcement manner. Enterprises that meet the basic conditions of enterprise R&D institutions may apply to the municipal and county science and technology management departments and submit relevant materials as required; the municipal and county science and technology management departments shall submit applications to the Provincial Department of Science and Technology for approval after review, and those that meet the conditions shall be filed.

Chapter IV Support Measures

Article 11 Enterprise R&D institutions shall enjoy the R&D investment reward of enterprise R&D institutions in accordance with the relevant provisions of the "Several Fiscal Policies of Hainan Province to Promote High-quality Economic Development" and other relevant provisions. The reward funds and the incremental R&D expense rewards of high-tech enterprises and high-tech enterprise cultivation pools applied by the enterprise in the same year shall be supported according to the principle of higher non-duplication.

Article 12 Newly recognized provincial enterprise R&D institutions such as provincial key laboratories, technology innovation centers, manufacturing innovation centers, engineering laboratories, academician workstations, academician team innovation centers, and scientific and technological achievements transformation centers shall implement recognition rewards in accordance with the original method. For those who have not enjoyed the one-time recognition reward, they shall enjoy the one-time reward in accordance with the "Several Fiscal Policies of Hainan Province to Promote High-quality Economic Development" and the "Three-Year Action Plan for Hainan Province to Win the Turnaround of Scientific and Technological Innovation with Extraordinary Means (2021-2023)" after filing with the provincial science and technology management department.

Article 13 All cities and counties are encouraged to introduce relevant policies to support and reward enterprise R&D institutions.

Article 14 The provincial enterprise R&D institution recognition reward funds shall not be used for expenditures unrelated to scientific and technological innovation. It shall not be used to pay various fines, donations, sponsorships, investments, debt repayments, and other expenditures prohibited by national regulations.

Article 15 Enterprises that have been approved to register provincial enterprise R&D institutions can enjoy the relevant credit support of the "Interim Measures for the Management of Risk Compensation of Science and Technology Credit in Hainan Province".

Chapter 5 Management and Supervision

Article 16 Municipal and county science and technology management departments are responsible for the supervision and management of enterprise R&D institutions in their regions; provincial enterprise R&D institution recognition departments are responsible for the supervision and management of provincial enterprise R&D institutions. If the qualification is cancelled due to non-compliance with the regulations, it should be reported to the provincial science and technology management department for filing in a timely manner.

Article 17 If a registered enterprise R&D institution has a major change related to the recognition conditions, it should report to the provincial science and technology management department within two months. If it does not meet the filing conditions after review, the qualification will be cancelled.

Article 18 For those who have been registered as provincial-level enterprise R&D institutions, the certification department shall conduct a review in accordance with the original management measures; for those who have been registered as municipal and county-level enterprise R&D institutions and other enterprise R&D institutions, the science and technology management departments of the cities and counties where they are located shall conduct a review. The review is generally conducted in the form of written review, and on-site inspections may be combined if necessary. Those who pass the review will retain their qualifications, and those who fail will be disqualified.

Article 19 If there are serious frauds in the application, registration, and review process, the corresponding administrative decisions shall be revoked, the reward funds shall be recovered, and the relevant units and personnel shall be held accountable in accordance with the law.

Article 20 The supporting units of enterprise R&D institutions shall consciously accept the supervision and inspection of science and technology, finance, auditing, and supervision departments.

Article 21 If the relevant units or individuals make deviations or mistakes in the process of enterprise R&D institution identification and management, and are diligent and responsible and do not seek personal gain, they shall be exempted from relevant responsibilities or given a lighter punishment, and timely correct the mistakes and make corrections to effectively eliminate and reduce losses.

Chapter VI Supplementary Provisions

Article 22 Cities and counties are encouraged to formulate management measures for the identification of municipal and county-level enterprise R&D institutions in accordance with these measures.

Article 23 These measures shall be interpreted by the science and technology management department of Hainan Province.

Article 24 These measures shall come into force on October 22, 2021.
