Article 1 These Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of Hainan Free Trade Port in order to promote the high-quality development of Sanya Central Business District in Hainan Free Trade Port. Article 2 Sanya Central Business District includes the Phoenix Coast Unit in Tianya District of Sanya City and the East Coast Unit, Yuechuan Unit, and Hailuo Unit in Jiyang District. The specific scope shall be delineated, adjusted, and announced by the People's Government of Sanya City in accordance with relevant procedures. Sanya Central Business District shall, in accordance with the relevant requirements of the construction of Hainan Free Trade Port, benchmark the world's highest level of openness, innovate systems and mechanisms, take the lead in international cooperation, development and construction, industrial development, investment promotion, industrial-city integration, and institutional innovation, build a development system with headquarters economy, financial services, modern commerce, cruise yachts, professional services, cultural leisure, etc. as key industries, and create a modern service industry innovation development pilot zone. Article 3 The Provincial People's Government and the Sanya Municipal People's Government shall strengthen the leadership of the work of Sanya Central Business District, coordinate and solve major problems in construction and development, decide major matters and major projects, and establish and improve the assessment and evaluation reward and punishment mechanism. The provincial people's government and the Sanya municipal people's government and their relevant departments shall support the construction and development of Sanya Central Business District in terms of institutional innovation, infrastructure construction, industrial development, land, finance, taxation, finance and talent introduction. The district people's government where Sanya Central Business District is located is responsible for exercising the social management functions of Sanya Central Business District. Article 4 The Sanya Municipal People's Government shall establish a management agency in Sanya Central Business District in accordance with the law. The management agency is a statutory agency that performs corresponding administrative management and public service duties in Sanya Central Business District. It is specifically responsible for the comprehensive coordination, development and construction, operation management, industrial development, institutional innovation, investment promotion, business environment construction and other work of Sanya Central Business District, and exercises corresponding powers in accordance with authorization or entrustment. Based on the principle of streamlining and efficiency, and in accordance with relevant regulations, the Sanya Central Business District Management Agency shall implement an enterprise-based and market-based employment mechanism and salary system within the approved total salary amount, and independently decide on the establishment of institutions, positions, personnel recruitment, salary standards, etc., except for personnel appointed in accordance with relevant regulations. The person in charge, senior management personnel and other staff of the Sanya Central Business District Management Agency may be selected and hired from abroad. Article 5 The Provincial People's Government, Sanya Municipal People's Government and their relevant departments shall delegate or entrust the Sanya Central Business District Management Agency to exercise relevant management powers in accordance with the law based on actual needs. For management powers that are not suitable for delegation or entrustment, the Provincial People's Government, Sanya Municipal People's Government and their relevant departments may establish district-based agencies in Sanya Central Business District in accordance with regulations. The relevant departments of the Provincial People's Government and Sanya Municipal People's Government, district-based agencies, and Sanya Central Business District Management Agency shall clarify the management powers in Sanya Central Business District, compile power lists and responsibility lists in accordance with the law, and clarify the corresponding in-process and post-process supervision responsibilities in the responsibility lists, and announce them to the public after approval. Article 6 The Sanya Central Business District Management Agency may adopt the forms of joint construction and entrusted management to build cross-regional cooperative industrial parks. Sanya Central Business District is encouraged to explore ways such as one district with multiple parks and enclave economy, integrate or host other parks, cooperate and complement each other, develop jointly, and build an open innovation community. Article 7 The Sanya Central Business District Management Agency may establish or introduce development and operation enterprises in accordance with the law, entrust enterprises to be responsible for the land development, investment promotion, industrial investment and construction and operation of infrastructure and public service facilities in the Sanya Central Business District, and participate in the organization and implementation of the management services of the Sanya Central Business District. The Sanya Central Business District Management Agency shall perform the duties of an investor for the invested enterprises in accordance with the authorization of the Sanya Municipal People's Government, and enjoy the rights of investors such as asset income, participation in major decisions and selection of managers in accordance with the law. Assets belonging to the Sanya Central Business District Management Agency built on the land supplied by the Sanya Central Business District for a fee, or industrial buildings, offices, commercial, residential and other properties coordinated and constructed by the Sanya Central Business District Management Agency, can be used for industrial support, public services and talent housing in the Sanya Central Business District. The Sanya Central Business District Management Agency shall coordinate the planning, allocation and management of the above assets. Article 8 The Sanya Central Business District Management Agency shall innovate the system and mechanism of development and construction, and explore new investment and financing models with multiple levels and channels. The Sanya Central Business District Management Agency explores innovative construction project engineering consulting, cost, insurance, approval, supervision, evaluation and other mechanisms, and supports relevant professional institutions and personnel in the field of overseas engineering construction to participate in the development and construction of the park in accordance with the relevant provisions of the Hainan Free Trade Port. Article 9 The Provincial People's Government and the Sanya Municipal People's Government and their relevant departments shall support the high-quality development of the Sanya Central Business District in accordance with laws and regulations when formulating medium- and long-term development plans and annual plans. The Sanya Central Business District Management Agency shall organize the preparation of industrial development plans, detailed plans and related special plans in accordance with the Sanya National Economic and Social Development Plan, the National Land Space Master Plan, etc., and implement them after approval in accordance with relevant regulations. The Sanya Central Business District Management Agency is encouraged to innovate the planning preparation method and management system. The Sanya Municipal People's Government shall coordinate the connection between the Sanya Central Business District and the surrounding area planning, and promote the integrated and coordinated development of regional infrastructure, public service facilities and other supporting facilities. Any cross-regional project that needs to use the land or sea area of ​​the Sanya Central Business District or may affect the development of the Sanya Central Business District shall seek the opinions of the Sanya Central Business District Management Agency; if no consensus is reached, the Sanya Municipal People's Government shall decide. Article 10 The People's Government of Sanya City may authorize the management agency of Sanya Central Business District to be responsible for the supervision, management and development of land within the park, except for land acquisition. The Provincial People's Government and the People's Government of Sanya City shall coordinate the annual planning indicators of new construction land in Sanya Central Business District, giving priority to key industries and key projects. In Sanya Central Business District, land resources can be integrated and revitalized through acquisition, replacement, equity investment, cooperative development and other methods; unsupplied government reserve land within the park can be utilized through leasing, temporary use and other methods, but it shall not affect the normal supply of land; flexible and diverse land supply methods such as allocation, transfer, leasing, valuation and capital contribution or equity investment can be adopted in accordance with the law; it is allowed to use rural stock collective business construction land for industrial projects and affordable rental housing construction through transfer, leasing and other methods in accordance with relevant regulations. In Sanya Central Business District, mixed land use such as new industrial land and logistics land can be promoted; land or sea areas with project operation plans and indicator assessment plans can be transferred on a trial basis. Sanya CBD can explore land management reforms such as short-term urban use of buildings, vertical development of underground space, and layered empowerment; explore multi-purpose sea use methods such as three-dimensional layered sea use to ensure the sea area use needs of industrial projects such as cruise ships, yachts, cultural leisure, etc. in the park, and promote the coordinated development of marine industries. Article 11 Support the coordinated promotion of urban renewal in Sanya CBD, and take the lead in innovative exploration in urban renewal mechanisms, models, and management. The district people's government where Sanya CBD is located shall accelerate the land preparation and urban renewal work within the scope of Sanya CBD to ensure the development and construction of the park. The land used for urban renewal can be allocated in a paid use method or allocation method such as transfer, lease, valuation, or equity investment in accordance with the law. Article 12 Support Sanya CBD to gather international organizations, multinational companies, listed companies, corporate headquarters and treasury centers, supply chain management and settlement centers, R&D centers and other functional headquarters to create a high-quality headquarters economy agglomeration area. Encourage the establishment of professional institutions in Sanya CBD to serve headquarters enterprises in fund management, trade logistics, data flow, talent introduction, etc. For qualified headquarters enterprises, the Sanya Central Business District Management Agency shall formulate special policies in conjunction with relevant departments to provide support. Article 13 Support Sanya Central Business District to pilot financial reform and innovation policies, build a pilot zone for financial expansion and opening up, and improve the level of financial industry opening up. Support international green finance certification institutions to settle in Sanya Central Business District, and support financial institutions in Sanya Central Business District to carry out green finance business. The Sanya Central Business District Management Agency shall cooperate with financial management departments to promote the construction of digital financial system in accordance with laws and regulations, promote the development of inclusive finance with data integration applications, enrich the application pilot scenarios and industrial ecology of digital RMB, and encourage units and individuals to use digital RMB. The Sanya Central Business District Management Agency shall cooperate with financial management departments to strengthen financial risk prevention, strengthen supervision of financial business and product innovation, and ensure the financial security and stability of the Central Business District. Article 14 Sanya Central Business District relies on trading venues such as Hainan International Carbon Emissions Trading Center and Hainan International Commodity Trading Center to carry out international carbon emissions trading, international commodity trading and other businesses. Article 15 Sanya Central Business District shall connect with international high-level economic and trade rules, expand trade functions, innovate and develop new international trade, gather high-level trade platforms and entities, promote the deep integration of finance and trade, strengthen the support of international trade industry, and create a leading area for the development of modern commercial and trade industries. Support the development of offshore trade and cross-border service trade in Sanya Central Business District, promote the facilitation of foreign exchange receipts and payments and settlement of goods trade and service trade, improve trade service systems such as trade financing and insurance, and build a cross-border e-commerce service center. Article 16 The management agency of Sanya Central Business District shall, together with relevant departments, promote the high-quality development of digital trade, explore the relaxation of access to new digital economy formats, promote the international mutual recognition of digital certificates and electronic signatures, build international Internet data dedicated channels, international data information dedicated channels and application support platforms based on advanced technologies such as blockchain, and promote the facilitation of digital trade delivery and settlement. Article 17 Support the construction of a cruise tourism pilot zone in Sanya Central Business District, promote the construction of a smart cruise home port in Sanya Central Business District, attract international cruise registrations, expand international routes, develop home port supporting services such as port services, ship maintenance, supply, and seafarer services, and build an international distribution center for cruise tourism onshore. Support park enterprises to develop cruise financing leasing and inspection and testing businesses. Accelerate the construction of cruise terminals, improve port inspection infrastructure, and support the opening of international cruise routes and cruise Hainan sea tour routes. Article 18 Support the construction of Hainan Yacht Industry Reform, Development and Innovation Pilot Zone in Sanya Central Business District, establish and improve the yacht industry standard system, regularly conduct yacht industry market credit evaluation, and promote the development of yacht industries such as consumption, trading, research and development, and design. Explore the entry and exit customs clearance mode for foreign personnel through yacht tourism, and promote the convenience of customs clearance for yacht tourists. Article 19 Support the development of exhibition economy in Sanya Central Business District, hold exhibitions, forums, events and other activities with global influence, cultivate and introduce well-known exhibition leading enterprises, domestic and foreign professional exhibition organizations, international brand exhibitions and their upstream and downstream supporting enterprises, and expand the scale of exhibition economy. Article 20 Relying on the China Hainan International Cultural Relics and Artworks Trading Center, Sanya Central Business District provides an open, professional, convenient and efficient international trading platform for excellent artworks from countries along the "Belt and Road" and tradable cultural relics that comply with relevant laws and regulations on cultural relics protection. Encourage well-known domestic and foreign auction institutions to conduct business in the trading center. Support the establishment of cultural relic stores and market-oriented cultural relic restoration and protection institutions in Sanya Central Business District. Encourage well-known domestic and foreign cultural relic and art appraisal and evaluation institutions to settle in Sanya Central Business District. The management agency of Sanya Central Business District shall establish a trading supporting service system such as bonded warehousing, exhibition display, appraisal and evaluation of cultural relics and artworks, and promote relevant departments to provide support in terms of customs clearance convenience, bonded goods supervision, warehousing and logistics. Article 21 Support Sanya Central Business District to cultivate and introduce international legal, accounting and other professional service institutions and related talents, promote the gathering of service elements, and provide intensive, digital and market-oriented one-stop professional services for market entities. Article 22 The management agency of Sanya Central Business District shall optimize the business environment, strengthen the protection of property rights of enterprises in the park, and protect the investment, income and other legal rights and interests of natural persons, legal persons and unincorporated organizations in Sanya Central Business District in accordance with the law. The management agency of Sanya Central Business District shall optimize enterprise-related services, establish a mechanism to ensure the landing of investment projects and a mechanism for tracking services throughout the project. By building special service channels for enterprises and setting up full-time positions for enterprise services, it provides high-quality and convenient services such as agency and co-organization, policy consultation, and customs clearance business guidance for investment projects, and promptly coordinates and solves problems in project approval, construction and production and operation. Government service matters shall not be converted into intermediary service matters. The management agency of Sanya Central Business District shall improve the channels for enterprise-related complaints and establish a sound mechanism for accepting, handling and feedback of complaints and reports from enterprises in the park. Article 23 The management agency of Sanya Central Business District shall innovate investment promotion methods and incentive mechanisms, formulate industrial development support policies in the park within the statutory authority, and strictly implement various contracts signed with enterprises in accordance with the law in investment promotion and other activities. Except for those that need to be kept confidential according to law, the formulation and revision of enterprise-related policies shall fully listen to the opinions and suggestions of enterprises in the park. Article 24 The management agency of Sanya Central Business District shall unify government service standards, implement and deepen the reform of extremely simplified approval in accordance with the law, explore the establishment of an investment system of "standard system ' commitment system" in accordance with the law in areas with mandatory standards, optimize the approval process, and improve management efficiency and service level. Article 25 The management agency of Sanya Central Business District shall reasonably use new information technology to accelerate digital transformation and comprehensively improve the efficiency of government services and digital governance capabilities. Relying on the provincial data sharing service portal and the provincial government data unified open platform, improve the open sharing mechanism of government information and public data, promote the development and utilization of data resources, and integrate the circulation of data elements between government and enterprises. Article 26 Sanya Central Business District shall independently carry out high-level talent identification in accordance with the Hainan Free Trade Port High-level Talent Identification Method and Classification Standards, and may appropriately relax the conditions such as diplomas, age, and professional titles for urgently needed and scarce talents and international talents in accordance with actual conditions. The Sanya Central Business District Management Agency shall provide efficient and convenient services for domestic and foreign high-level talents and urgently needed and scarce talents in terms of settlement, tax payment, spouse employment, children's schooling, housing, social security, etc. in accordance with relevant regulations. The Sanya Central Business District Management Agency may set up special funds for market-oriented operations to strengthen the training and introduction of talents. Article 27 The Sanya Central Business District Management Agency shall build an intellectual property public service platform and improve the intellectual property service system based on the needs of park enterprises for intellectual property services, and promote the innovative development of intellectual property creation, application, management and services. Encourage park enterprises and other organizations and scientific researchers to carry out independent innovation and improve the quality and efficiency of patent output. Explore and promote the securitization of intellectual property rights, improve the intellectual property trading system and trading mechanism, and support park enterprises to use equity and intellectual property rights for pledge financing. Article 28 This Regulation shall come into force on October 1, 2023.
