The "Regulations on the Establishment and Operation Management of the Hainan Lingshui Li'an International Education Innovation Pilot Zone Administration (Revised)" has been reviewed and approved at the 11th Executive Meeting of the Eighth Hainan Provincial People's Government on July 3, 2023, and is hereby promulgated and shall come into force from the date of promulgation.

Regulations on the Establishment and Operation Management of the Hainan Lingshui Li'an International Education Innovation Pilot Zone Administration (Revised)

Chapter I General Provisions

Article 1  In order to innovate the management system and operation mechanism of the Hainan Lingshui Li'an International Education Innovation Pilot Zone (hereinafter referred to as the Pilot Zone) and standardize the operation of the Hainan Lingshui Li'an International Education Innovation Pilot Zone Administration (hereinafter referred to as the Administration), these Regulations are formulated in accordance with relevant laws and regulations and in combination with the actual construction of the Hainan Free Trade Port.

Article 2  The Administration is a statutory institution that performs corresponding administrative management and public service duties in the Pilot Zone and has the status of an institutional legal person. The legal representative is the director of the Administration. The Administration implements corporate management and professional operation in line with international standards in accordance with the principles of streamlining and efficiency.

Chapter II Main Responsibilities

Article 3 The Administration shall perform the management responsibilities delegated or entrusted by the Provincial People's Government and its functional departments, the Lingshui Li Autonomous County People's Government and its functional departments in accordance with legal procedures.

The main responsibilities are to create a centralized display window for the new benchmark of China's education openness and development in the new era and an important pilot area for the construction of a free trade port with Chinese characteristics, and to make important contributions to China's expansion of education opening up and the construction of the Hainan Free Trade Port.

Specifically responsible for the planning and construction of the pilot zone, comprehensive coordination, school guarantee, operation management, industrial development, investment promotion, institutional innovation, and enterprise (institution) services.

The Lingshui Li Autonomous County People's Government mainly performs other duties outside the Administration within the scope of the pilot zone.

Chapter III Operation Mechanism

Article 4 The Administration implements the director responsibility system under the leadership of the Hainan Lingshui Li'an International Education Innovation Pilot Zone Council (hereinafter referred to as the Council).

The Council is responsible for studying, planning and promoting major issues such as cooperative education planning and system integration innovation in the pilot zone, actively seeking the Ministry of Education and other relevant departments to increase support for the pilot zone; coordinating the introduction of high-level universities at home and abroad; coordinating and promoting the solution of major issues such as land and finance in the development of the pilot zone, and ensuring the high-standard construction and high-quality development of the pilot zone.

Article 5  The Council shall be approved by the Provincial People's Government and operate in accordance with the relevant provisions of the Charter. One Chairman shall be appointed, who shall be concurrently appointed by the person in charge of the Provincial People's Government; one Executive Vice Chairman shall be appointed, who shall be concurrently appointed by the principal person in charge of the Provincial Department of Education; two Vice Chairmen shall be appointed, who shall be concurrently appointed by the Deputy Secretary-General and the Director of the Administration Bureau in charge of the Provincial People's Government. The member units of the Council are composed of the Provincial Development and Reform Commission, the Provincial Department of Natural Resources and Planning, the Provincial Department of Science and Technology, the Provincial Department of Finance, the Provincial Department of Education, and Lingshui Li Autonomous County, and the member units shall be increased or decreased as needed. The Secretariat of the Council shall be located in the Provincial Department of Education, and the Secretary-General shall be concurrently appointed by the person in charge of the Provincial Department of Education.

Article 6  The Administration shall establish Hainan Lingshui Li'an International Education Innovation Experimental Zone Development and Construction Co., Ltd. as a state-owned enterprise for the development and construction of the experimental zone and market-oriented investment and financing, and shall undertake the primary development of land in the zone, financing, infrastructure construction, and operation and management of the experimental zone in accordance with laws and regulations. The Administration shall perform the duties of the investor on behalf of the Provincial People's Government.

Article 7  The Administration shall establish Hainan Lingshui International United College as a platform-type institution for cooperation between the Administration and the universities stationed in the zone, actively seek guidance and support from the provincial industry authorities, serve and guarantee the operation of the schools in the experimental zone, discuss the integrated innovation of the education system, and promote the high-quality development of international education. Hainan Lingshui International United College is allowed to apply for higher education in accordance with the law when conditions are ripe.

Chapter 4 Staffing and Personnel Management

Article 8  Team staffing of the Administration. The Administration shall have 1 director (who shall be concurrently the main person in charge of Lingshui Li Autonomous County), 1 executive deputy director, several deputy directors, and 1 chief academic dean (specially appointed technical position, a member of the team). The deputy director and the chief academic dean shall be nominated by the director and appointed by the board of directors after the approval of the provincial people's government. They shall be employed on a contract basis. If the candidate is a provincial cadre, it shall be handled in accordance with relevant regulations.

Article 9 The Administration Bureau enjoys independent autonomy in employing personnel. Except for part-time leaders, it shall independently decide on personnel employment, job setting, and salary standards within the total salary range. A salary management system shall be established that is consistent with performance goals. The salary standards for different positions at the same level may be different.

Chapter V Finance and Investment and Financing Management

Article 10 The income of the Administration Bureau mainly includes financial subsidies, service income and other legal income.

Article 11 The state-owned assets developed by various investment entities in the pilot zone can be entrusted by the relevant investment entities to the Administration Bureau for overall operation management and value preservation and appreciation.

Article 12  In addition to guaranteeing the investment in municipal infrastructure and public services such as education and health in the pilot zone through the application of fiscal funds, it is encouraged to attract social capital to participate in the basic construction of the pilot zone and broaden the source of funds; support Hainan Lingshui Li'an International Education Innovation Pilot Zone Development and Construction Co., Ltd. to carry out market-oriented and diversified financing and operation under the premise of controllable risks.

Chapter VI Others

Article 13 The Provincial People's Government shall assess the operational performance of the Administration on an annual basis. The Administration shall establish an information disclosure system, disclose major matters, financial budgets and final accounts in accordance with the law, and accept audit supervision by the auditing authority.

Article 14 The pilot zone may set up industry consultation and co-governance platforms and consulting agencies according to development needs.

Article 15  These regulations shall come into force on the date of promulgation. The "Regulations on the Establishment and Operation Management of the Hainan Lingshui Li'an International Education Innovation Pilot Zone Administration" (Order No. 292 of the Hainan Provincial People's Government) promulgated by the Provincial People's Government on August 28, 2020 shall be repealed at the same time.
