In order to fully implement General Secretary Xi Jinping's important speech at the conference celebrating the 30th anniversary of Hainan's establishment as a province and the establishment of a special economic zone and his important instructions on the construction of Hainan Free Trade Port, and thoroughly implement the "Guiding Opinions of the CPC Central Committee and the State Council on Supporting Hainan's Comprehensive Deepening of Reform and Opening Up" (Zhongfa [2018] No. 12) and the "Overall Plan for the Construction of Hainan Free Trade Port", and promote the high-quality development of industrial parks across the province, this method is formulated in combination with the actual situation of our province.
This method applies to tourism, modern service industry, high-tech industry and other parks approved and established in accordance with regulations throughout the province.
Chapter 1 Park Establishment
Article 1 The conditions for the establishment of municipal and county-level parks should adhere to intensive concentration and strict control of the establishment of parks.
(i) It is in line with the provincial national economic and social development plan, the provincial master plan and the master plan of the city, county and autonomous county where it is located;
(ii) It has the corresponding industrial foundation and advantages in location and transportation, which are conducive to attracting investment;
(iii) It complies with the relevant provisions of the state and the province on natural ecology, environmental protection and national security;
(iv) The regional scope and boundaries are clear, and the land use scale is reasonable;
(v) The industrial positioning is clear and meets the requirements of the provincial industrial layout;
(vi) The input-output per unit land area, energy consumption and carbon emission targets of the park meet the relevant provincial regulations (in principle, the park's tax revenue in the previous year reached 500 million yuan or the per mu tax reached 60% of the average value of similar provincial parks);
(vii) It is approved by the provincial park development and construction joint meeting.
Article 2 Conditions for the establishment and recognition of provincial parks. Municipal and county-level parks that meet the basic conditions of industrial parks and the following conditions can apply to be recognized as provincial industrial parks:
(i) The dominant industry is prominent, the industrial concentration is high, the growth is good, the innovation ability is strong, and the radiation and driving effect on the local economy is significant;
(ii) The per-mu tax revenue of the park in the previous year reached 80% of the average value of similar provincial parks, and the land unit input-output and other indicators reached 80% of the average value of similar provincial parks;
(iii) The unit output energy consumption and carbon emissions meet the relevant energy-saving and carbon reduction requirements, and the pollutant emission intensity is lower than the pollutant emission standards of our province;
(iv) The park infrastructure construction, on the basis of the "five connections and one leveling" of water supply, drainage, power supply, roads, communications, and site leveling, simultaneously promotes greening and lighting construction, and realizes at least two of the heating, gas supply, broadband network, and cable TV, achieving "seven connections and one leveling";
(v) A special management agency has been established to establish a management system, operation mechanism and related public service platform with strong coordination capabilities exclusive to the park.
Article 3 Procedure for the Recognition of Provincial Parks If a city or county-level industrial park needs to be upgraded or a provincial industrial park is established, the municipal, county, or autonomous county people's government shall submit an application to the provincial people's government. After the provincial people's government approves it, the provincial development and reform commission will organize an assessment and evaluation with relevant provincial departments, and then make a review suggestion, which will be submitted to the provincial people's government for review and approval. If an industrial park needs to be renamed, expand its planned area, or adjust its location, it shall be reported to the provincial park development and construction joint meeting in accordance with the procedures, and it can only be implemented after approval.
Hainan Province's provincial-level high-tech industrial development zones shall be implemented in accordance with the "Hainan Province Provincial-level High-tech Industrial Development Zone Recognition and Management Measures" (Qiong Fu Ban [2017] No. 45). The recognized Hainan Province's provincial-level high-tech industrial development zones shall be reported to the provincial park development and construction joint meeting for filing and included in the provincial industrial park management.
New parks may be established to implement major strategic deployments of the state and Hainan Province, and included in the overall consideration of the provincial park layout.
Article 4 Provincial Park Certification Application Materials The following materials shall be submitted when applying for upgrading or establishing a provincial industrial park:
(i) Application for upgrading or establishing a park;
(ii) Approval documents for establishing a park;
(iii) Materials and relevant information proving the conditions for a provincial industrial park;
(iv) Relevant planning and approval documents for the park;
(v) Review opinion documents for the environmental impact report of the park planning.
Chapter II Operation Management
Article 5 Division of Responsibilities
(i) Joint Conference System A joint conference system for the development and construction of provincial parks in Hainan Province shall be established to lead and coordinate decision-making on major issues in the development and construction of industrial parks across the province. The executive vice governor shall serve as the convener, and the members shall be composed of relevant departments of the provincial government. The joint conference shall set up an office in the Provincial Development and Reform Commission to be responsible for the daily work of the joint conference.
(ii) Responsibilities of local governments and provincial departments The main responsibilities of the park are the local municipal (county) people's government and the park management agency. The provincial industry authorities shall provide corresponding guidance according to industry categories, and shall be mainly responsible for industrial policy support, operation monitoring, coordination and promotion of major projects, assessment and evaluation, etc.
(III) Responsibilities of the Park Management Agency The provincial, municipal, county, autonomous county people's governments and the Yangpu Economic Development Zone Management Committee may set up park management agencies based on the approval authority. Further streamline administration and delegate power, grant industrial parks more flexible and relatively independent management authority, and establish a system that matches power, responsibility and interests. The park management agency shall perform the following duties:
1. Formulate various statutory plans and special plans such as the park detailed plan and industrial development plan, and organize their implementation after review or approval;
2. Be responsible for the park's investment promotion and foreign economic and technological cooperation;
3. Be responsible for or cooperate with relevant departments to complete the approval or review of the park's investment projects, and provide good enterprise services and management;
4. Formulate and implement relevant policies, management systems and work regulations of the park;
5. Be responsible for the guidance, supervision and coordination of relevant institutions in the park;
6. Be responsible for various statistical work related to the park economy.
Article 6 Scientific planning of the park shall strictly follow the requirements of the provincial "multi-plan integration" to prepare the park detailed plan, industrial development plan, and relevant special plans, and assist relevant departments or entrust relevant institutions to prepare reports on soil and water conservation assessment, energy conservation assessment, natural disaster risk assessment, environmental risk assessment, safety risk assessment, planning environmental impact assessment, etc. in the park, and organize implementation after review or approval in accordance with legal procedures.
Article 7 Investment promotion actively introduces high-quality domestic and foreign-funded enterprises to participate in the development and construction of the park. Encourage industrial parks to innovate investment promotion methods, vigorously develop industrial chain investment promotion, point-to-point investment promotion, commissioned investment promotion, network investment promotion, etc., to improve the effectiveness of investment promotion. Continuously improve investment promotion policies, systems and service systems, and take creating a high-quality business environment as an important measure for investment promotion. Strengthen overall coordination to ensure the implementation of projects. After the project is implemented, follow-up services for enterprises should be provided to understand and solve various problems encountered by enterprises.
Article 8 Industry-city integration Improve the investment and financing mechanism of park infrastructure, put the protection and consolidation of the park's ecological environment first, reasonably layout life services and productive services, incorporate the residential, transportation, medical, cultural and educational systems into the park planning, coordinate the construction of urban functions such as living areas, business areas, and office areas, and promote industry-city integration.
Article 9 Construction Sequence Industrial parks should follow the objective laws of park economic development, scientifically arrange the annual construction scale and development sequence, and make timely adjustments according to the situation of industrial development and project construction, and promote land development and infrastructure construction from a high starting point, in a planned, step-by-step, and step-by-step manner to ensure the healthy and orderly operation and innovative development of the park.
Chapter III Policy Support
Article 10 System Integration Innovation Put system integration innovation in a prominent position, take risk prevention and control as the bottom line, liberate the mind, boldly innovate, use the legislative power of the special economic zone and the relevant laws and regulations of the Hainan Free Trade Port, encourage and support the park to boldly try and boldly break through, and accelerate the establishment of a more flexible park management system that is compatible with the Hainan Free Trade Port.
(I) Create a legal, international and convenient business environment. The simplified approval system will be promoted and applied in the industrial park in accordance with the law, and the reform of the comprehensive approval system and mechanism of the industrial park will be promoted, and the approval authority will be delegated to the industrial park to the maximum extent. Build a "smart industrial park", provide integrated e-government, further optimize "non-face-to-face approval", and deeply promote "one-network, one-time and full-network" to improve the efficiency of approval. Clean up and standardize administrative approval intermediary services, and create a fair, open, transparent and efficient government operation system. Strengthen the supervision of enterprise investment and operation during and after the event, and implement the "double random, one public" supervision full coverage.
(II) Improve the system and mechanism for the market-oriented allocation of production factors. Give full play to the decisive role of the market in resource allocation, and the provincial, municipal (county) governments will fully delegate power to the industrial park, take the lead in exploring and promoting the market-oriented allocation of factors such as land, labor, and capital in the industrial park, and smooth the flow channels of industrial park factors. Actively promote the separation of government and enterprises, and the separation of government and capital, support the separation of industrial park management agencies and development and operation enterprises, and accelerate the transformation of industrial park management and operation to specialization and marketization.
Article 11 Pioneering and piloting support high-level trade and investment liberalization and facilitation policies in the industrial park, and promote the construction of the "single window" platform for international trade in the industrial park for pilot promotion. Strengthen the construction of special customs supervision areas, and take the lead in implementing the import and export management system of "first-line liberalization" and "second-line control" in key parks. Support the park to use the "origin policy" of Hainan Free Trade Port to guide industrial development. Support the investment and financing platform companies of the park to issue bonds, stocks, etc. to broaden financing channels. Support the park to give priority to pilot projects in cross-border capital flow, industrial opening to the outside world, and cross-border data flow.
Article 12 Talent Policy Support the park to build a first-class talent ecosystem to ensure that talents can be attracted, retained, and used well.
(I) Implement more competitive talent introduction policies, support professional and technical and management talents of state-owned enterprises and institutions to work part-time and receive salary in the park according to regulations, and receive remuneration according to work. Support the park to carry out the introduction and management of "migratory talents". Talents introduced by the park can enjoy the corresponding talent policies of our province according to regulations, and the park can also implement special personnel management systems, talent allowance systems and talent settlement fee systems according to the needs of attracting talents.
(II) Support the park to establish a "single window" for talent services to provide talents with simple, fast and efficient services. The park provides convenience in scientific research, housing, medical care, employment, education and other aspects for high-level talents, scarce talents and other talents working in the park.
(III) Innovate the establishment and job management methods, and expand the autonomy of the park management agency in hiring. Establish a personnel appointment system and a performance-based salary system, implement market-oriented remuneration and benefits, and fully mobilize the work enthusiasm of all types of personnel.
Article 13 Innovation and Entrepreneurship Improve the Park's Innovation and Entrepreneurship Service System:
(I) Parks with conditions should actively introduce and develop mass innovation spaces, business incubators and accelerators, and establish a complete industrial incubation service system. Strengthen the construction of public technology, human resources, investment and financing, intellectual property and other service platforms. The park can use provincial assessment and evaluation reward funds for talent incentives and the improvement of the park's innovation service capabilities.
(II) Encourage well-known scientific research institutes, universities, scientists, high-level talents, and innovation and entrepreneurship teams at home and abroad to set up R&D institutions in the park, arrange a certain number of staff and financial support according to project needs, and the local government of the park will provide supporting funds, office space and other conditions.
(III) The park is encouraged to establish angel investment funds, venture capital funds, private equity investment funds and other venture capital guidance funds, and form a joint force with the government investment fund under the framework of the Overall Plan for Hainan Free Trade Port Government Investment Guidance Fund to jointly support the construction and development of the park.
(IV) If the enterprises or their technical personnel, scientific research institutions or their R&D personnel in the park obtain national or provincial science and technology progress awards, or apply for invention patent authorization and software copyright, the park will give a one-time reward.
Article 14 Land Guarantee Improve the land guarantee mechanism for the park:
(I) The construction land of the park should comply with the national land use policy, provincial and municipal and county master plans, industrial park master plans and control detailed plans, and development plans. The city and county shall give priority to the allocation of new construction land plan indicators.
(II) Natural resources and planning departments at all levels shall give priority to the construction land and construction indicators of major infrastructure and supporting facilities in the park such as education, medical care, and talent apartments. Encourage and support the construction of underground comprehensive pipeline corridors in parks with mature conditions, and build ecological parks and smart parks.
(III) The park should reasonably formulate a land acquisition and storage plan, coordinate the progress of land acquisition and storage, guide the transformation and upgrading of projects with inefficient land use, tap potential, and ensure the efficient implementation of industrial projects.
(IV) For industrial projects that supply land within the key parks of Hainan Free Trade Port, the park management agency shall be given the autonomy to implement the "Hainan Province Construction Land Transfer Control Index (Trial)", allowing the park to refer to the current indicators and independently determine the three indicators of "investment intensity index", "annual output value index" and "tax index" of industrial projects according to actual conditions, and sign industrial project development and land access agreements with land users in accordance with relevant regulations after land transfer.
(V) Encourage municipal and county governments to innovate land acquisition and demolition models, improve demolition and land acquisition and resettlement compensation policies, and encourage village collectives to participate in park development and construction in accordance with relevant regulations using collective land for commercial construction.
Article 15 Financial support Increase financial support for park development:
(I) The provincial finance department allocates a certain amount of funds for park development each year to support the construction of provincial key industrial park infrastructure, public supporting service facilities, industrial incubation system, public service platform, etc.
(II) When arranging projects and allocating relevant funds, provincial departments should focus on industrial parks and support the construction of infrastructure and supporting systems such as transportation, energy, environmental protection, fire protection, housing projects, standardized factories, research sites, scientific research equipment, high-end talent introduction, and human resources services in industrial parks.
(III) Encourage park management agencies (park platform companies) and provincial industry departments directly under the park, and cities and counties where the park is located to jointly formulate targeted support policies based on the principle of "one park, one policy".
(IV) Strengthen the supervision of fiscal funds during and after the event. In accordance with the principle of "who approves, who supervises, who is in charge, who supervises", strengthen the supervision and inspection of fiscal funds. The park should use all kinds of special funds received for special purposes and special accounts, and actively accept supervision and inspection by the finance, audit, discipline inspection and supervision departments.
Chapter IV Performance Appraisal
Article 16 Appraisal System and Procedures Establish a scientific and complete park assessment and evaluation system and implement a park economic quality and efficiency evaluation mechanism. In addition to the park's total economic indicators, the assessment content also includes indicators such as main business income, tax contribution, investment intensity, industrial cluster development, and functional improvement. The assessment is organized and implemented by the Provincial Development and Reform Commission, and is carried out in accordance with the procedures of "information collection, local preliminary review, data verification, quantitative assessment and evaluation, and result release". The assessment results will be reported to the provincial government for review and then announced, and will serve as an important reference for the hierarchical dynamic management of the park and the selection and appointment of cadres in the park management agency.
Article 17 Reward and Punishment Measures The Provincial Development and Reform Commission will assess the development of industrial parks in accordance with the "Measures for the Assessment and Evaluation of Key Industrial Parks in Hainan Province", and will give corresponding rewards and punishments based on the assessment results. At the same time, the assessment results will be used as a reference factor for the allocation of provincial key industrial development special funds and other related industrial support funds.
Article 18 Dynamic Adjustment According to the principle of "total control and dynamic management", combined with the actual industrial development and park assessment situation, dynamic adjustment will be implemented. For those who rank low in the assessment, have serious inefficient land use and idleness, and have developed
The parks with poor development results shall be rectified, and those that are still unqualified after rectification shall be downgraded or delisted after approval by the provincial government. The original park area is no longer suitable for park development, or the original site selection is not scientific enough, and the location or four-boundary range can be adjusted. Parks with similar locations and smaller scales should be optimized and integrated.
This method shall be implemented 30 days after the date of publication, and the Provincial Development and Reform Commission shall be responsible for interpretation.
