In order to implement the requirements of the "Overall Plan for Hainan Free Trade Port", promote the optimization of resource allocation and reasonable layout of projects in various parks across the province, promote industrial agglomeration, accelerate the development of the province's "3'1" industrial system, actively implement the "bring in, go out" strategy, based on their own needs and the strengths of the other party, and take co-construction and sharing, high-quality industrial development as the orientation, to achieve mutual benefit and win-win results, this implementation opinion is formulated.
1. Scope of application of "enclave economy"
(I) Park aspect
"Provincial enclave" refers to the key parks, provincial parks and municipal and county parks of the free trade port as "transfer-out places" or "transfer-in places". "Inter-provincial enclave" is to encourage our province's parks to "bring in", support the coordinated introduction of advantageous resources and advantageous industries of advanced regions and advanced parks to cooperate in the construction of industrial parks (more than 200 mu).
(II) Industry aspect
Guided by the "3'1" industrial system, it complies with the requirements of energy conservation and emission reduction, safe production, environmental protection and relevant laws and regulations, and is consistent with the industrial planning, industrial layout and industrial function positioning of the "transfer-in place". The industries involved must comply with the provisions of the "Catalogue of Encouraged Industries for Hainan Free Trade Port (2020 Edition)" and the "Guiding Opinions on Industrial Structure Adjustment in Hainan Province during the 14th Five-Year Plan Period", excluding various real estate projects.
(III) Projects
1. Cross-city and county cooperative park projects (total investment of RMB 100 million or foreign investment of more than US$10 million). It mainly refers to the cooperative parks or projects in which the "transfer-in" allocates a certain area of land (more than 200 mu) locally and jointly invests with the "transfer-out" or is independently invested, developed and constructed by the "transfer-out" area.
2. Cross-city and county relocation industry projects (total investment of RMB 100 million or foreign investment of more than US$10 million). It mainly refers to the enterprise relocation projects that are led and promoted by both the "transfer-in" and "transfer-out" areas, and the tax registration is handled by tax authorities at all levels in our province. Due to the actual production and operation being moved from the "transfer-out" area to the "transfer-in" area, the tax collection and management relationship needs to be adjusted according to policy regulations.
3. Cross-city and county new industry projects (total investment of RMB 500 million or foreign investment of more than US$50 million). It mainly refers to projects where both the "transfer-in" and "transfer-out" places have made great efforts in the process of investment promotion, and the specific identification is negotiated by both parties. Strategic emerging industry projects can appropriately lower the standards and be determined by the "transfer-in" place; at the same time, the undertaking entity must be an independent legal person enterprise registered and paying taxes in the "transfer-in" place, and operate and manage in accordance with the law, with a sound accounting and management system.
The identification of "intra-provincial enclaves" and "inter-provincial enclaves" projects is determined by the "transfer-in" and "transfer-out" places through negotiation, and reported to the Hainan Provincial Park Development and Construction Joint Conference Office for filing, and copied to the Provincial Department of Finance, Provincial Bureau of Statistics, and Provincial Taxation Bureau.
II. Division of responsibilities, benefit sharing and investment sharing
(I) Division of responsibilities
1. “Enclaves within the province”
The “transferring land” undertakes the energy consumption indicators and investment promotion work of the project, and participates in the “enclave” park in the form of “factor equity”. The “transferring land” is responsible for the local work such as land acquisition and agricultural conversion approval, land supply, environmental impact assessment, production safety, administrative approval, industry supervision, etc., which shall be determined by the “transferring land” and the “transferring land” according to the actual situation. In principle, the “transferring land” shall bear the new construction land indicators, forest land quota indicators, and cultivated land occupation and compensation indicators. If the “transferring land” cannot guarantee them, the “transferring land” may bear or partially bear them, which shall be determined by negotiation between the two parties.
2. “Inter-provincial enclaves”
Keep a close eye on advanced regions and advanced parks, make full use of the free trade port policy, and build “inter-provincial enclave” parks in various ways such as cooperation and co-construction between the two sides.
(II) Benefit Sharing
The main purpose is to build a benefit sharing and investment sharing mechanism for the "intra-provincial enclave" parks, mobilize the enthusiasm of both parties, and form a win-win cooperation situation. The tax sharing between cities and counties is jointly applied to the Provincial Department of Finance by the "transfer-in" and "transfer-out" places after consensus, and the Provincial Department of Finance handles the adjustment matters through the annual financial settlement of the province and cities and counties in accordance with the procedures. The "inter-provincial enclave" parks explore the use of market-oriented methods to build a win-win cooperation mechanism.
1. "Intra-provincial enclave"
(1) The "transfer-in" place is responsible for collecting taxes, and the specific sharing ratio can be determined by negotiation between the two parties and reported to the Provincial Department of Finance and the Provincial Taxation Bureau for filing.
(2) The relevant statistical work shall be carried out in accordance with the current national statistical system regulations, and the government statistics department of the "transfer-in" place is responsible for statistics. The specific sharing ratio shall be determined by negotiation between the two parties and reported to the Provincial Bureau of Statistics for filing. The data shared by the “enclave economy” is only used for the annual assessment of cities, counties (parks), and cities, counties (parks) are not allowed to publish or use them publicly. The basic statistical data of cities, counties (parks) are still counted and used externally according to the “local statistics” caliber.
(3) The sharing period is determined by the “transfer-in” and “transfer-out” parties based on factors such as the park infrastructure investment, the nature of the park project, and preferential policies.
2. “Inter-provincial enclaves”
The statistical work related to the “enclave economy” project shall be carried out in accordance with the “Statistical Law of the People’s Republic of China” and relevant laws and regulations and the current national statistical system.
(III) Investment sharing
The investment of the “enclave economy” project is determined by the “transfer-in” and “transfer-out” parties based on factors such as the park infrastructure investment, the nature of the park project, and preferential policies.
III. Support policies
(I) In the annual comprehensive assessment of the park, extra points will be awarded to parks or projects with outstanding results. Among them, the comprehensive evaluation of the park that substantially promotes the implementation of the "enclave economy" project will be increased by 1 point, the comprehensive evaluation of the park that forms a landmark project (implemented in the same year, with a total investment of RMB 1 billion or foreign investment of more than US$100 million during the project construction period) will be increased by 1 point, and the comprehensive evaluation of the park that generates more than RMB 100 million in tax revenue will be increased by 1 point, and the points can be accumulated.
(ii) "Enclave economy" projects, provided that they meet the relevant regulations and conditions, can be given priority in applying for inclusion in the provincial key (major) projects of the current year, and priority in applying for various industrial funding support of the current year.
(iii) "Inter-provincial enclave" projects with a total investment of RMB 1 billion or foreign investment of more than US$100 million will guarantee land demand in accordance with the "Notice of the General Office of the People's Government of Hainan Province on Doing a Good Job in Land Element Guarantee for Provincial Key (Major) Projects".
(iv) Priority will be given to selecting parks with better foundations and projects with higher maturity in "Haicheng Wendi", "Greater Sanya" and Danzhou Yangpu areas to explore the "enclave economy" model. Support the Boao Lecheng International Medical Tourism Pilot Zone to strengthen linkage with Haikou National High-tech Industrial Development Zone, Hainan Ecological Software Park, and Qionghai City to form a "front shop and back factory" pattern. Support Haikou Jiangdong New District and Qiongshan District to strengthen linkage, rely on Jiazi Airport to explore the "enclave economy", and create a new model for the general aviation and business jet industry in Haikou Jiangdong New District.
(V) Adhere to the "project is king", and "transfer-out" and "transfer-in" should be based on project cooperation. Establish a "enclave economy" project library at the provincial level and implement dynamic adjustments.
(VI) Encourage "enclave economy" cooperation in accordance with market principles and methods. Encourage partners to jointly establish investment and financing companies, adopt government and social capital cooperation (PPP), PPP ' REITs, PPP and special bonds and other models, and attract social capital to participate in park development, project development, industry introduction and operation management. Support improving the professional operation level of the park, support entrusting part or all of the park's affairs to third-party operation and management through franchising, government procurement of services, etc., and areas with mature conditions can explore the separation of park management and daily operations.
