Notice of the Provincial Department of Transportation on Issuing the Implementation Rules for the Management of “Zero Tariff” Operating Vehicles in Hainan Free Trade Port (Trial)

Article 1 These implementation rules are formulated to implement the Notice of the Ministry of Finance, the General Administration of Customs and the State Administration of Taxation on the "Zero Tariff" Policy for Vehicles and Yachts in Hainan Free Trade Port (Finance and Customs Tariff [2020] No. 54), the Customs Implementation Measures for the "Zero Tariff" Policy for Vehicles and Yachts in Hainan Free Trade Port (Trial) (Announcement of the General Administration of Customs [2021] No. 1) and the Notice of the People's Government of Hainan Province on Issuing the "Zero Tariff" Imported Vehicles and Yachts Management Measures for Hainan Free Trade Port (Trial) (Qiongfu [2020] No. 60).
Article 2 These implementation rules apply to the management of "zero tariff" operating vehicles registered in Hainan Free Trade Port before the whole island is closed. The term "operating vehicles" as mentioned in these rules refers to "zero tariff" passenger vehicles used for regular road passenger transport, chartered passenger transport, tourist passenger transport, urban public transport, small and micro passenger car rental and operation services, cruising taxis that meet the requirements of new energy, and online taxi booking services, and "zero tariff" freight vehicles used for road freight (including general cargo transport, special transport and large-scale transport) and dangerous goods transport and operation services.
Article 3 "Zero tariff" operating vehicles can engage in passenger and freight transport operations to and from the mainland. At least one of the origin and destination must be in the Hainan Free Trade Port, and the cumulative stay time in the mainland shall not exceed 120 days per natural year (calculated on a natural day basis, regardless of the number of times). Among them, passenger and freight vehicles from the Hainan Free Trade Port to the mainland "point-to-point" and "go and return" are not subject to the number of days.
Article 4 The time for "zero tariff" operating vehicles to enter and leave the island and the number of days they stay in the mainland shall be collected and analyzed by the Provincial Transportation Security Center based on the Qiongzhou Strait Ferry Network Ticketing System and the Hainan Province "Zero Tariff" Imported Vehicles and Yacht Supervision System (hereinafter referred to as the "Supervision System") for online collection and analysis. For vehicles that have stayed on the island for a total of 100 days per natural year, the Provincial Transportation Security Center will send a notification to the vehicle owner through the supervision system to remind them. For vehicles that have stayed on the island for more than 120 days per natural year, the Provincial Transportation Security Center will send a notification to the vehicle owner, and at the same time provide the vehicle's entry and exit details and other information to Haikou Customs and the State Administration of Taxation Hainan Provincial Taxation Bureau through the provincial government information sharing and exchange platform. Before the network transmission is realized, the Provincial Department of Transportation will provide relevant information regularly in the form of letters.
Article 5 "Zero tariff" passenger vehicles from Hainan Free Trade Port to the mainland "point-to-point" and "go and return" refer to vehicles that have obtained operating licenses in accordance with the law and are engaged in inter-provincial regular passenger transport, inter-provincial chartered passenger transport and inter-provincial tourist passenger transport. "Zero tariff" freight vehicles from Hainan Free Trade Port to the mainland "point-to-point" and "go and return" refer to vehicles that have obtained road freight business licenses in accordance with the law, whose freight service starting point is at least one end in Hainan Free Trade Port, whose driving routes and stopovers are relatively fixed, and return immediately after loading and unloading goods.
Article 6 Enterprises (hereinafter referred to as "enterprises") that own "zero tariff" passenger and freight transport vehicles from Hainan Free Trade Port to the mainland "point-to-point" and "go-and-return" shall apply for filing of relevant vehicle information to the transportation authorities of the cities and counties where they operate in the province in accordance with the requirements of the attached table (see the attachment for details). Among them, inter-provincial regular passenger transport enterprises shall apply for filing within 15 working days from the date of obtaining the "Road Transport Certificate". If the operating vehicles have not changed, fill in once a year; inter-provincial chartered passenger transport, inter-provincial tourist passenger transport, freight (including general cargo transport, special transport and large-scale transport), dangerous goods transport and other enterprises shall apply for filing at least 1 working day in advance before carrying out the corresponding business. After receiving the application, the competent department shall complete the review within 1 working day, and after the review, the vehicle information shall be simultaneously submitted to the Provincial Department of Transportation and the Transportation Security Center.
The Provincial Transportation Security Center shall promptly provide the information of "zero tariff" passenger and freight transport vehicles engaged in "point-to-point" and "go-and-return" from Hainan Free Trade Port to the mainland through the supervision system to Haikou Customs, the State Administration of Taxation, Hainan Provincial Taxation Bureau and other units and the Hainan Social Management Information Platform. Before the network transmission is realized, the Provincial Department of Transportation shall provide relevant information regularly in the form of a letter.
Article 7 If the "zero tariff" passenger and cargo transportation vehicles engaged in "point-to-point" and "return-on-the-spot" transportation from Hainan Free Trade Port to the mainland violate these implementation rules, they will be managed in accordance with the provisions that the annual entry and exit time of other "zero tariff" operating vehicles shall not exceed 120 days.
Article 8 During the customs supervision period, when the enterprise submits a report on the use of "zero tariff" operating vehicles in the previous year to the competent customs or the local customs (hereinafter referred to as the "competent customs") before June 30 (inclusive) of each year, it shall also copy the Provincial Department of Transportation and the local transportation authorities.
Article 9 During the customs supervision period, if the enterprise really needs to transfer the "zero tariff" operating vehicles due to bankruptcy or other reasons, it shall apply to the competent customs in accordance with the regulations, handle the transfer after the customs review and approval, and complete the vehicle registration and operation change procedures. The time of entry and exit of the transferred vehicles and the number of days they stay outside the island shall continue the relevant information before the transfer and be included in the cumulative calculation of the same natural year.
Article 10 The Provincial Department of Transportation shall be responsible for interpreting these implementation rules.
Article 11 These implementation rules shall be implemented on a trial basis from the date of promulgation.
