General Administration of Customs "Regulations of the People's Republic of China on the Supervision of Yangpu Bonded Port Area"

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the Customs Law of the People's Republic of China and other relevant laws and regulations in order to create a free trade port with Chinese characteristics that is more open, has a better business environment and has a stronger radiation effect, serve the national opening-up strategy in the new era, give full play to the pioneering role of Yangpu Free Trade Port, support the construction of a pilot zone for free trade ports, and standardize the customs management of Yangpu Free Trade Port.

Article 2 Customs shall supervise the means of transport, goods, articles entering and leaving Yangpu Free Trade Port and enterprises in Yangpu Free Trade Port in accordance with these Measures.

Article 3 Physical fence management is implemented in Yangpu Free Trade Port. Between Yangpu Free Trade Port and other areas within the customs territory of the People's Republic of China, checkpoints, fences, video surveillance systems and other facilities required for customs supervision that meet the requirements of customs supervision shall be set up.

Article 4 Unless otherwise provided by laws, regulations and current policies, foreign goods entering the zone shall be bonded or duty-free; goods leaving the zone for sale outside the domestic zone shall go through customs declaration procedures in accordance with relevant provisions on the import of goods, and tax shall be levied according to the actual status of the goods; goods from outside the domestic zone entering the zone shall be deemed as exports and tax refunds shall be implemented.

For goods produced by encouraged industrial enterprises in the zone that do not contain imported materials or contain imported materials and are processed in the Yangpu Free Trade Port Area with a value-added of more than 30% (inclusive), when they leave the zone and enter the domestic zone for sale outside the zone, they shall be exempted from import tariffs, and import value-added tax and consumption tax shall be levied in accordance with regulations. Relevant measures shall be formulated separately.

Article 5 The Management Committee of Yangpu Economic Development Zone shall establish a public information service platform to realize data exchange and information sharing between management agencies, customs and other regulatory departments within the zone; establish and improve the system of active disclosure of information on major events.

Article 6 Goods and articles prohibited by the state from entering or leaving the country shall not enter or leave the Yangpu Free Trade Port Area.

The customs implements risk management for security access involving national entry and exit restrictions, port public health safety, biosafety, food safety, commodity quality safety, intellectual property rights, etc. The customs shall supervise and inspect inbound and outbound goods and articles, import and export goods and articles, and international transit goods in accordance with the law.

Article 7 Unless otherwise specified, goods entering and leaving the Yangpu Free Trade Port Area from outside the country shall be subject to customs trade statistics, and statistical methods shall be formulated separately.

Goods entering and leaving the Yangpu Free Trade Port Area from outside the country and other related goods shall be subject to customs single statistics.

Goods transferred or transferred between enterprises within the area, and goods between the Yangpu Free Trade Port Area and other customs special supervision areas or bonded supervision places shall not be included in customs statistics.

Chapter II Supervision of goods entering and leaving the Yangpu Free Trade Port Area and abroad

Article 8 In principle, inbound and outbound goods that need to be quarantined according to law shall be inspected at the supervision work place (site) in the port supervision area. With the approval of the customs, inspections may be carried out at qualified places in the Yangpu Free Trade Port Area.

Entry inspections of bulk resource commodities subject to statutory inspections, solid wastes that can be used as raw materials, etc. shall be carried out at the supervision work place (site) in the port supervision area.

For the inspection items of animal and plant products entering the zone from abroad, the policy of "enter the zone first, then test" shall be implemented, and subsequent disposal shall be carried out according to the test results.

Article 9 Goods entering and leaving Yangpu Free Trade Port Area and abroad shall not be subject to license management, except for those clearly stipulated by laws, regulations, international treaties and agreements concluded or participated in by my country or involving security access management.

Article 10 For goods entering and leaving Yangpu Free Trade Port Area and abroad that fall within the scope specified in Articles 8 and 9 of these Measures, enterprises shall go through declaration procedures with the customs; if they do not fall within the above scope, the customs shall release them directly.

Chapter III Supervision of goods entering and leaving Yangpu Free Trade Port Area and outside the domestic area

Article 11 The import and export of goods between Yangpu Free Trade Port Area and outside the domestic area shall be declared in accordance with existing regulations. For goods entering the domestic area from Yangpu Free Trade Port Area, the importing enterprise shall go through import declaration procedures with the customs. For goods entering Yangpu Free Trade Port Area from outside the domestic area, the exporting enterprise shall go through export declaration procedures with the customs.

Article 12 Unless otherwise provided, for goods entering and leaving the Yangpu Bonded Port Area from other special customs supervision areas, bonded supervision places, the enterprises in other special customs supervision areas and bonded supervision places shall declare the entry and exit registration list (customs declaration form).

Article 13 Goods that have been inspected when entering the area from abroad shall be exempted from inspection when leaving the area; for goods that fall within the scope of food hygiene supervision and inspection and commodity inspection, the customs may implement centralized pre-inspection in the area and write off the goods in batches upon application.

Article 14 Goods and articles that enter the area from within the country, are consumed and used in the area, do not leave the country, and are in reasonable quantity are exempted from filling in customs declaration forms or registration lists and submitting licenses.

Chapter 4 Supervision of Goods in Yangpu Bonded Port Area

Article 15 Enterprises in the area may carry out transit, assembly, storage, processing, manufacturing, trading, display, research and development, remanufacturing, testing and maintenance, distribution and delivery in accordance with the law.

Article 16 Large equipment such as aircraft, ships and marine engineering structures that do not meet the actual entry conditions for financing leasing enterprises registered in Yangpu Bonded Port Area shall be bonded and supervised by off-site entrustment according to the actual needs of logistics.

Article 17 The customs does not require enterprises in the area to set up customs accounts separately, but the accounting books, accounting vouchers, accounting statements and other accounting materials set up and compiled by enterprises in the area shall record and reflect the relevant business conditions truthfully, accurately and completely. If they can be correctly and completely recorded and calculated by computers, the accounting records stored and output by their computers shall be deemed as accounting materials.

Article 18 The customs shall conduct audits and inspections on enterprises in the area in accordance with the law.

Article 19 The customs shall supervise the inbound goods declared by enterprises in the area in general trade in accordance with the current regulations.

Chapter V Supervision of International Transit Goods in Yangpu Bonded Port Area

Article 20 Except for goods prohibited from entry and exit by the state, other goods can be internationally transited in Yangpu Bonded Port Area (including transit consolidation, the same below).

Article 21 The international transit business of Yangpu Free Trade Port Area shall be carried out in a dedicated work place that meets the requirements of customs supervision.

Article 22 The obligor for electronic data transmission of manifest shall transmit the original manifest, pre-allocation manifest, loading manifest, distribution application, international transit order and other electronic data of transit and consolidation goods to the customs manifest management system in accordance with relevant management regulations.

Article 23 International transit goods shall be re-exported within three months. Under special circumstances, the re-export period may be extended for three months with the approval of the customs.

Chapter VI Supervision of Directly Entering and Exiting Goods and Goods and Articles Carried by Transport Vehicles and Individuals Entering and Exiting Yangpu Free Trade Port Area

Article 24 If goods enter or exit the country directly through Yangpu Free Trade Port Area, the customs shall supervise them in accordance with the relevant provisions on entry and exit.

Article 25 The service personnel of inbound and outbound transport vehicles and their personal articles entering and exiting Yangpu Free Trade Port Area shall be supervised by the customs in accordance with the current regulations.

Article 26 A dedicated channel for freight vehicles, other vehicles and personnel to enter and exit the checkpoints of the entry and exit area of ​​Yangpu Free Trade Port Area shall be set up. Domestic transport vehicles and personnel entering and leaving Yangpu Free Trade Port shall be subject to customs supervision and inspection.

Article 27 After public health risk assessment, telecommunication quarantine shall be implemented for inbound transport vehicles that meet the requirements of telecommunication quarantine.

Chapter VII Supplementary Provisions

Article 28 Comprehensive bonded zone policies and institutional innovation measures are applicable to Yangpu Free Trade Port.

Article 29 Any violation of the provisions of these Measures that constitutes smuggling or violation of customs supervision provisions, as well as any violation of laws and regulations that requires customs to impose administrative penalties, shall be punished by the customs in accordance with the provisions of relevant laws and regulations; if it constitutes a crime, criminal liability shall be pursued in accordance with the law.

Article 30 The General Administration of Customs shall be responsible for interpreting these Measures.

Article 31 These Measures shall come into force on the date of publication.
